TERMS & CONDITIONS (TERMS OF SERVICE) — Mattie Professional

2) Scope and definitions
2.1 These Terms & Conditions apply to every offer, order and agreement made via
mattiepro.com (the “Website”).
2.2 If you are a consumer (buying outside your trade/business), mandatory consumer laws apply.
If you are a business customer, consumer withdrawal rules do not apply.
3) Using the Website
3.1 You must be at least 18 years old (or have permission from a parent/guardian) to place an order.
3.2 You may not misuse the Website, interfere with its security, or use it for unlawful purposes.
4) Offers, product information and availability
4.1 We present product information as accurately as reasonably possible. Obvious mistakes
(e.g., clear pricing/typing errors) do not bind us.
4.2 Product images are for illustration; colors may differ per screen.
4.3 If an item becomes unavailable after you order, we will inform you as soon as possible and
refund any amounts paid for that item.
5) Ordering and contract formation
5.1 You place an order by completing checkout. Before you pay, you can review and correct your details
and see the total price (including any applicable VAT and any shipping costs).
5.2 The agreement is concluded when you receive our order confirmation by email
(or when we dispatch the goods, whichever is earlier).
5.3 We may refuse or cancel orders in case of suspected fraud, misuse, chargeback risk, or other legitimate reasons.
If we cancel after payment, we will refund the paid amount.
6) Prices, VAT and payment
6.1 Prices are shown in EUR (or local currency where displayed). The final total (including any applicable VAT and
shipping costs) is shown at checkout before you pay.
6.2 For deliveries outside the EU, local import duties, import VAT, customs handling fees and/or other charges may be
applied by local authorities or the carrier. These charges are outside our control and are the customer’s responsibility.
6.3 We accept the payment methods shown at checkout. If a payment fails or is reversed, we may suspend or cancel the order.
7) Delivery
7.1 We ship from The Netherlands to the destinations available at checkout.
7.2 Dispatch timing: We aim to dispatch orders as quickly as possible after payment confirmation
(and after any necessary fraud checks). Where available, we use DHL or FedEx services and provide tracking.
7.3 Delivery times shown on the Website are estimates and may vary due to carrier performance, peak periods, weather,
customs processes, or other factors outside our control.
7.4 Risk of loss/damage passes to you when you (or a third party indicated by you, other than the carrier) take physical possession of the goods.
8) Right of withdrawal (consumers only — legal right)
8.1 You have the legal right to withdraw from the contract within 14 days without giving any reason.
8.2 The withdrawal period expires 14 days after the day you (or a third party indicated by you, other than the carrier)
receive the goods (or the last item, if delivered separately).
8.3 To exercise the right of withdrawal, you must inform us of your decision to withdraw by an unequivocal statement
(e.g., email to info@mattiepro.com). You may use the Model Withdrawal Form in section 18, but it is not obligatory.
8.4 Return deadline: you must send the goods back no later than 14 days from the day you communicate your withdrawal to us.
8.5 Refund deadline: If you withdraw, we will refund all payments received from you, including standard outbound delivery costs
(if applicable and if the entire order is returned), without undue delay and in any event no later than 14 days after we are informed of your decision.
We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent them back—whichever is earlier.
8.6 We will reimburse using the same means of payment you used, unless agreed otherwise.
8.7 If we provide a pre-paid return label and you choose to use it, the label cost may be deducted from your refund as the direct cost of returning the goods (see section 9).
8.8 Diminished value: You are liable for any diminished value of the goods resulting from handling beyond what is necessary
to establish the nature, characteristics and functioning of the goods.
9) Return shipping costs (consumers)
9.1 Return shipping is not free. Unless we explicitly offer free returns, you bear the direct cost of returning the goods.
9.2 If we provide a pre-paid return label and you choose to use it, the label cost will be deducted from your refund after the return is received.
9.3 Where applicable, the return label cost depends on destination and carrier rates and will be communicated when the label is issued. By using the label, you agree to the deduction from your refund.
10) Voluntary 30-day return policy (extra service)
10.1 In addition to the legal 14-day withdrawal right, we offer a voluntary 30-day return period starting from the day you receive your order.
10.2 This voluntary 30-day policy is an extra service and does not limit your legal rights.
10.3 Voluntary 30-day returns are only accepted if the product is unopened, unused, and in its original packaging in resalable condition.
If these conditions are not met, we may refuse the voluntary return or apply a reduction in value where appropriate.
10.4 The practical conditions and steps are described on our Return & Refund Policy page. Where the voluntary policy differs
from the legal right of withdrawal, the legal right always remains available to consumers.
10.5 Return shipping costs also apply to voluntary 30-day returns. If a pre-paid return label is provided and used, the label cost will be deducted from your refund.
11) Defective items, wrong items and legal guarantee (conformity)
11.1 If your product is defective, damaged on arrival, or you received the wrong item, contact us promptly at
info@mattiepro.com with photos and your order number.
11.2 Consumers are entitled to goods that conform to the contract. If they do not, you may have the right to repair, replacement,
price reduction, or termination as provided by law.
12) Promotions and discount codes
12.1 Discount codes cannot be combined unless explicitly stated.
12.2 We may end or change promotions when the stated conditions require it (e.g., end date, stock limits), without affecting
existing orders already confirmed.
13) Intellectual property and user content
13.1 All content on the Website (text, images, logos, product names, designs) is owned by or licensed to us and may not be used
without prior written consent, except where allowed by law.
13.2 If you post reviews or other content, you guarantee it is lawful and does not infringe third-party rights.
We may remove content that is clearly unlawful or misleading.
14) Privacy
We process personal data in accordance with our Privacy Policy.
15) Liability
15.1 Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
15.2 To the extent permitted by law, we are not liable for indirect or consequential damages (such as lost profit), except in cases
of intent or gross negligence.
15.3 Our total liability for direct damages is limited to the order amount for the relevant order, unless mandatory law requires otherwise.
16) Force majeure
If we cannot perform our obligations due to circumstances beyond our reasonable control, we may suspend performance for the duration of that event or cancel the agreement if performance becomes impossible.
17) Changes to these Terms
We may update these Terms. The latest version is always available on this page. Changes do not affect orders already confirmed.
